The applicant company's application for an order that the European Commission was bound, under art 340 of the Treaty on the Functioning of the European Union, to compensate the applicant for damage incurred due to its unlawful conduct which had led to the applicant losing its opportunity of being awarded the contract at issue, was allowed. The General Court of the European Union held that the applicant had succeeded in establishing the causal link between the Commission's unlawful conduct and the applicant's loss of opportunity and the costs and expenses incurred in participating in that call for tenders.
