United States of America v Nirvana

Extradition – Extradition order. The US government's appeal against a district judge's decision to refuse that government's request for the respondent's extradition from the US to face criminal prosecution in Maine, was dismissed. The Divisional Court held that the well established criminal duality rule, which required that the conduct of which the respondent was accused in the US had to constitute a criminal offence under UK law, was not satisfied.
