Practice – Jurisdiction. The defendant company's application, that the court should either not exercise its jurisdiction or stay the claim against it, failed. Article 25 of Council Regulation (EC) 44/2001 applied, with the result that the court had jurisdiction to hear the claim and lacked jurisdiction to stay proceedings under the Regulation. The Commercial Court held that the court not only had jurisdiction, but had no power or discretion to decline that jurisdiction.
