Disclosure and inspection of documents – Production of documents. The claimants claimed some US$65m against the defendants for alleged breaches of warranty, following the sale of the defendants' aerospace business to them via a share capital purchase. The defendants sought further, more focused, disclosure orders arising out of what they said were the fundamental deficiencies in the claimants' disclosure concerning certain folders or file paths. The Technology and Construction Court, applying settled law, held that it would be neither reasonable, nor proportionate to order any further disclosure of the folders or file paths. However, the court held that the steps the claimants had taken, namely using computer assisted review technology to review only 1% of some 220,000 documents had not been adequate and that some form of manual search of 25% of the documents was required.
