Trade mark – Registration. The Chancery Division dismissed TripAdvisor LLC's appeal against a hearing officer's decision granting the registration of the respondent's logo mark 'handsam Schooltripsadvisor' for certain goods and services. It held that the hearing officer had not erred in finding that there was no likelihood of confusion, under s 5(2) of the Trademark Act 1994, and that the respondent's mark would not take unfair advantage of, or be detrimental to, the distinctive character or the repute of TripAdvisor's marks, under s 5(3) of the Act. The hearing officer had not failed to undertake a global assessment as alleged and he had made decisions to which he had been entitled.
