Thornton (as Executrix of the Estate of Thorton, Deceased) v Homerton University Hospital NHS Trust

Medical practitioner – Negligence. The defendant NHS Trust's hospital's treatment of the deceased had been in accordance with a range of reasonable responses to the information available, in circumstances where the deceased had presented with a lodged food bolus that dislodged without intervention by way of hospital treatment and prior to any consultation with the hospital's doctor. The Queen's Bench Division held that the defendant had carried out a reasonable examination, had made reasonable enquiries of the deceased and had come to a decision that had been in the circumstances consistent with its duty and had not breached the same.
