The Court of Justice of the European Union ruled that art 33(2) of Council Regulation (EC) 6/2002 meant that a licensee might bring proceedings alleging infringement of a registered Community design which was the subject of the licence although that licence had not been entered in the register. Further, art 32(3) of the Regulation meant that the licensee could claim damages for its own loss in proceedings for infringement of a Community design brought by it in accordance with that provision.
