European Union – Public procurement. The Court of Justice of the European Union ruled on a request for a preliminary ruling in relation to public works contracts that had a basic value of less than €5m, thereby falling outside the scope of Directive (EC) 2004/18. The Court held that contracts of such value were nonetheless subject to the fundamental rules and the general principles of the Treaty on the Functioning of the European Union, provided that those contracts were of certain cross-border interest. The Court concluded that the present request for a preliminary hearing was inadmissible as the contracts at issue were not of certain cross-border interest.
