Tattersall v Tattersall

Family proceedings – Orders in family proceedings. No formal process was stipulated by which an application for payment of arrears unenforceable without the leave of the court, in the present case periodical payments which were over 12 months old, had to be made and what was procedurally required would depend on the circumstances of the particular case. The Court of Appeal, Civil Division, further held that, although judges would be expected to typically to use Duxbury tables, a judge could decide to use a method of calculation other than Duxbury, in particular Ogden tables, and to do so was not an error of law.
