The General Court of the European Union dismissed the action by T & L Sugars Ltd and another company for damages for the loss which those companies had allegedly suffered, first, as a result of the adoption by the European Commission of certain measures designed to increase the supply of sugar on the European Union market; and second, as a result of the Commission's refusal to take the necessary measures to re-establish availability of supply in raw cane sugar. The General Court held that the necessary conditions for non-contractual liability of the EU had not been satisfied.
