Highway – Highway authority. The judge had been right to accept the CPR Pt 20 defendants' case that they were under no duty of care to users of the highway in respect of vegetation on the land at a junction that impaired visibility for users of the highway. The Court of Appeal, Civil Division, in dismissing the defendant's appeal against the judge's decision striking out his claim against the CPR Pt 20 defendants, held that it would not be just, fair and reasonable to find a duty of care in circumstances of the kind that existed.
