Negligence – Causation. The Queen's Bench Division, in a claim of medical negligence, held that whilst it had been satisfied that brain damage had been caused to the deceased claimant during a 26 minute period of circulatory arrest, whilst having a Hemi-Fontan procedure, it could not be said when during that period it had been caused, nor could it be said that the damage had been caused by any negligence of the surgeon who had performed the procedure.
