Negligence – Duty to take care. The claimant had been owed a duty of care, pursuant to the Occupiers' Liability Act 1957, by the defendant NHS Foundation Trust, which the defendant had breached and such breach of duty had been causative of the injuries sustained by the claimant. There had been different points at which the accident would or could have been prevented but those preventative measures had failed. The Queen's Bench Division held that, accordingly, there would be judgment for the claimant.
