Contract – Construction. The Technology and Construction Court ruled that it was appropriate to issue a declaration that the claimant, the employer under a building contract, and the defendant contractor had entered into a JCT Intermediate Contract with Contractor's Design 2011, whereby the defendant had agreed to carry out works at an address in London in substitution for a letter of intent, which had previously been issued. The letter of intent had plainly envisaged there would be a formally executed contract document in due course, but it had not made the existence of that document a pre-condition to the conclusion of a replacement contract.
