Conflict of laws – Jurisdiction. The English court lacked jurisdiction to entertain a claim against the second defendant, D2, in proceedings relating to the breakdown of a business partnership between the parties. The claimant had not established a good arguable case that, at the relevant time, D2 had still resided in the jurisdiction, or that, before then, D2 had not succeeded in effecting a distinct break in the pattern of his life in the UK, so as to cease to reside there. On the evidence, and applying the correct test of Swiss law, D2 had become domiciled in Switzerland as a matter of Swiss law by 5 April 2017.
