Civil procedure – Defamation action – Application for new trial. Court of Session: Refusing a motion by the defenders for a new trial in an action for damages for defamation, the jury having found in the pursuer's favour in a civil jury trial in 2006 and the pursuer having subsequently been convicted of perjury in criminal proceedings, the court rejected the defenders' contentions that it should order a new trial on the ground that the jury's verdict was contrary to the evidence or on the basis of res noviter veniens ad notitiam, and concluded that in all the circumstances a new trial was not essential to the justice of the cause between the parties.
