The local authority was granted an injunction against the defendants who had protested against the authority's tree felling programme, causing a number of planned tree fellings to be abandoned. The Queen's Bench Division held that the restriction that the authority had sought to impose was justified, and that the defendants' direct action against the felling had constituted the tort of tresspass and a criminal offence under s 303 of the Highways Act 1980.
