Immigration – Appeal. The Court of Appeal, Civil Division, permitted the appellant Secretary of State's appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber), allowing the respondent Jamaican national's appeal against the decision that it would not be disproportionate for him to be deported. As the Secretary of State's decisions had been no fresh claim decisions, the respondent had had no right of appeal in relation to either of them.
