It was in the best interests of the first respondents, who had both been incapacitated by exposure to a nerve agent, that further blood samples be taken from them and their medical records be disclosed for the purposes of the technical evaluation by the Director-General of the Organisation for the Prohibition of Chemical Weapons. Accordingly, the Court of Protection granted the declarations and orders sought by the Secretary of State for the Home Department, pursuant to ss 15 and 16 of the Mental Capacity Act 2005.
