The respondent asylum seeker's case would be remitted to the First Tier Tribunal (Immigration and Asylum Chamber) for a re-hearing regarding whether his case engaged the exceptions to the automatic deportation regime in s 32(5) of the UK Borders Act 200. The Court of Appeal, Civil Division, found that there had, amongst other things, been a failure to take into account relevant matters such as the respondent's criminality.
