Immigration – Asylum. The Court of Appeal, Civil Division, dismissed the appellant Secretary of State's appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber) (the UT), holding that it had not been open to the Secretary of State to withdraw the respondent's refugee status as she did and that he had rebutted the presumption that he constituted a danger to the community. The UT had not exceeded its jurisdiction, the change in the threat of Zimbabwean authorities did not mean that the circumstances of his grant of asylum had ceased to exist and the decision that he had rebutted the presumption had not been irrational.
