Immigration – Deportation. The First-tier Tribunal (Immigration and Asylum Chamber) (the FTT) had fallen into error in having concluded that the respondent's deportation to Barbados would breach his rights under art 8 of the European Convention on Human Rights. The Court of Appeal, Civil Division, in allowing the Secretary of State's appeal, further held that the Upper Tribunal (Immigration and Asylum Chamber) ought to have decided that the FTT had erred in law and ought to have set its decision aside.
