Secretary of State for the Home Department v MM (Zimbabwe)

Immigration – Deportation. The Court of Appeal, Civil Division, allowed the appellant Secretary of State's appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber), dismissing her appeal against the decision of the First-tier Tribunal (Immigration and Asylum Chamber), upholding the respondent Zimbabwean national's appeal against his deportation. The FTT had erred in its approach to the risk of ill-treatment on return to Zimbabwe and breach of art 8 of the European Convention on Human Rights on medical grounds.
