Immigration – Deportation. The Court of Appeal, Civil Division, in determining two appeals concerning the deportation of foreign criminals, held that the expression 'unduly harsh' in s 117C(5) of the Nationality, Immigration and Asylum Act 2002 and para 399 of the Immigration Rules required regard to be had to all the circumstances, including the criminal's immigration and criminal history.
