Secretary of State for the Home Department v Akbar

Appeal – Evidence. The Court of Appeal, Civil Division, allowed the Secretary of State for the Home Department's appeal against a decision of the county court, in which the judge allowed a statutory appeal against the imposition of a civil penalty on the owner of a business for employing illegal workers. The court held that the judge had been in error in allowing the appeal without examining the nature of the Secretary of State's procedural failings and the reasons for them.
