Damages – Measure of damages. The Court of Appeal, Civil Division dismissed an appeal by the defendant Secretary of State disputing that the claimant was entitled to compensation for a vaccine injury under the Statutory scheme in the Vaccine Damages Act 1979. The First-tier tribunal had been justified in looking (as it had done) to the future prognosis, on the balance of probabilities, in assessing whether the threshold had been crossed for the necessary 60% disablement.
