Sale of land – Contract. The Queen's Bench Division dismissed a claim for breach of contract brought by the claimant against the builders of her home, after she had tripped on a paving slab in her garden and suffered severe injuries. There was no evidence to support the existence of a collateral contract to the effect that the second defendant builder had agreed to come and remedy any defects the claimant later found in the property in consideration for the claimant agreeing to purchase it.
