Restraint of trade by agreement – Employer and employee. The Chancery Division allowed the claimant company's application to strike out elements of the defendants' counterclaim relating to competition law, in a dispute concerning the alleged breach of contract or fiduciary duty by the defendants, or as part of a conspiracy by the defendants to injure the claimant by unlawful means. The court held that the claim would proceed as an ordinary commercial dispute and would be case-managed accordingly.
