Water and sewerage – Recovery of charges for supply of water and sewerage services. Sheriff Court: In an action in which the pursuer sued for charges for the supply of water and sewerage services to the defender, which held the tenant's interest in the lease of a unit which formed part of a larger building, the defender's unit having no physical water or waste connections to the public system, the court concluded that 'premises' included not only the physical unit but also the right to use the communal toilets and kitchen and the right to use communal facilities turned the defender into an occupier of 'eligible premises'; the court did not consider the pursuer's pleadings regarding 'arrangements' with the defender for the supply of water and sewerage services to be lacking in specification and irrelevant and it allowed parties a proof of their respective averments.
