Savills (UK) Ltd v Blacker and another

Sale of land – Breach of contract. The Court of Appeal, Civil Division allowed the appeal of the claimant estate agent in respect of payment of commission in respect of the sale of the defendants' estate without the benefit of planning permission. There was nothing in the ordinary meaning of the language used in the agreement to justify reading the relevant passages as to an immutable contractual requirement binding on both parties that the estate be sold only after the grant of planning permission.
