Mental health – Court of Protection. The applicant NHS foundation trust's application to declare the best interests of P was considered by the Court of Protection. P lacked the mental capacity to communicate her own wishes and feelings in respect of life-sustaining medical treatment. The court did not give general guidance, but stressed that the Court of Protection always had to be driven by the needs of the patient and not by the exigencies of the litigation.
