The Court of Justice of the European Union gave a preliminary ruling, deciding that art 2(2) of Council Directive (EC) 2000/78, read together with art 4(1) of that directive, should be interpreted as not precluding legislation, such as that at issue in the main proceedings, which provided that candidates for posts as police officers who were to perform all the operational duties incumbent on police officers had to be under 35 years of age.
