Shipping – Charterparty. The proceedings concerned a shipping dispute arising from the bareboat charter of a vessel by the head owners. The Commercial Court made rulings as to the stakeholder claim that arose pursuant to CPR 86. Among other things, the court ruled that sums indisputably due to the head owners should be paid out to them and that the balance be paid out to the disponent owners, in order to fairly and equitably prevent the parties from incurring further costs.
