Immigration – Leave to remain – Fresh claim – Right to family life. Court of Session: Refusing a judicial review petition by an Indian national who challenged a decision refusing to recognise that his further submissions amounted to a fresh human rights claim under art 8 of the European Convention on Human Rights, the court held that there was no error in the respondent's conclusion that the petitioner had failed to raise anything new such as would be sufficient to advance his claim any further, that the respondent had properly regarded the claim as an attempt to characterise existing facts as new material and she had given sufficient reasons for her decision.
