European Union – Rules on competition. The General Court of the European Union had infringed essential procedural requirements by holding that the European Commission had not been obligated to organise a new hearing before adopting the contested decision by which it had held that the applicant undertaking had infringed art 65(1) of the Treaty constituting the European Coal and Steel Community in a continuous agreement and concerted practices in respect of the concrete reinforcing bars market. The Court of Justice of the European Union so held in an appeal by the applicant against the General Court's decision not to annul the contested decision. Consequently, the General Court's judgment would be set aside.
