Riley and others v Crown Prosecution Service

Animal – Protection. The Administrative Court partially allowed an appeal by way of case stated in respect of a purported prosecution under s 4 of the Animal Welfare Act 2006 as evidenced by a prosecutor's certificate pursuant to s 31 of the Act. The court found that the offence of animal cruelty under s 4(1) of the Act was not one of strict liability and required mens rea which had not been provided by the prosecution in respect of three appellants.
