Practice – Extradition. The Administrative Court held that extradition appeal notices had been filed at court and served on the respondents within the statutory seven-day period where the Crown Prosecution Service had filed the notices electronically after 2.30pm on the last day of that period, and the respondents had either been served simultaneously or minutes afterwards. The seven-day period set out in s 28 of the Extradition Act 2003 could not be curtailed by the provisions for electronic service set out in r 4.11 of the Criminal Procedure Rules.
