Disclosure and inspection of documents – Disclosure against persons not parties to proceedings. The Chancery Division made rulings concerning the disclosure of the names and details of any commercial funders and the details of the claimants' after the event (ATE) insurers in the course of the Royal Bank of Scotland rights issue litigation. The defendants' application for information about the claimants' third party funders would be allowed as appropriate. The court ruled on applications for disclosure of the details of third parties who, by virtue of contributing to the claimants' costs, were entitled to a share of any recovery that the claimants might make, and for disclosure of copies of documents including ATE policies.
