Re (a minor by her mother and litigation friend) and others v Calderdale & Huddersfield NHS Foundation Trust

Medical practitioner – Negligence. The Queen's Bench Division found the defendant NHS foundation trust negligent in its delivery of the first claimant, RE, due to the fact that it had delayed the summoning of help. That had been causative of the hypoxic injury suffered by RE. RE's mother, LE, and maternal grandmother, DE, were also held to have suffered post-traumatic stress disorder, which had been triggered by observing the events of RE's birth. RE, LE and DE were all entitled to claim damages.
