Re W (a child) (public law proceedings: child's separate representation)

Family proceedings – Orders in family proceedings. The Court of Appeal, Civil Division held that the judge had erred in deciding pursuant to the Family Procedure Rules, SI 2955/10, r 16.29, that a 16-year-old girl who previously had had separate representation could not have it in relation to the contesting of a care order. Not being able to instruct her own chosen solicitor meant she would lose the opportunity to have a continuing dialogue, with a professional in whom she had confidence and to receive advice in relation to her return to foster care.
