Sentence – Confiscation order. The applicant Prosecutor would be denied the grant of a declaration that monies transferred to the defendant's wife's account had been gifts. The Queen's Bench Division held, amongst other things, that it had been the modus operandi of the defendant to use other people's accounts, including his wife's account, to process his money. Accordingly, the beneficial interest in the said monies would remain with the defendant.
