Family proceedings – Jurisdiction. The Court of Appeal, Civil Division, dismissed the father's appeal against the judge's decision that the English court did not have jurisdiction in proceedings concerning his five-year-old son. Although the judge had erred in finding that 'English factors' had been irrelevant because the child had left lawfully, pursuant to a court order following a contested hearing at which his best interests had been considered, a full consideration of all the relevant facts would inevitably have led to the conclusion that he had been habitually resident in Finland.
