RM v Secretary of State for the Home Department

Immigration – Detention. The Administrative Court dismissed the claimant Iranian national's challenge to the legality of his immigration detention, as the defendant Secretary of State had discharged the burden of justifying in law the claimant's detention. Further, the challenge to the Secretary of State's decision to certify as clearly unfounded his claim that removal to Italy would breach his human rights was impossible on the basis of authority and further evidence added little to that previously considered.
