RF v Secretary of State for Work and Pensions (Mind and another intervening)

Social security – Personal independence payment. Paragraph 2(4) of the Social Security (Personal Independence Payment) (Amendment) Regulations 2017, SI 2017/194, which excluded those suffering from psychological distress from claiming under specified descriptors needed to obtain an award, could not be objectively justified and was manifestly without reasonable foundation. Accordingly, the Administrative Court, in allowing the claimant's application for judicial review, quashed that provision.
