Animal – Protection. The Divisional Court allowed the prosecution's appeal by way of case stated against the judge's decision, to dismiss the prosecution of the respondents for offences under s 4 of the Animal Welfare Act 2006 on the basis that the proceedings had been brought out of time. Had the judge approached the question posed by s 31(1)(b) of the Act as he ought, he would have been bound to have concluded that the prosecution commenced a few days after evidence sufficient to justify proceedings had come to the prosecution's knowledge had been brought in time.
