The body of concession or other evidence favourable to the defence adduced from the prosecution had not been such as to displace the overall weight of the prosecution case and the defendants' appeals against conviction for conspiracy to commit fraud by false representations were dismissed. However, the Court of Appeal, Criminal Division, reduced the second defendant's sentence, as it had been inappropriate for the judge not to have made some distinction in length of sentence as between the first defendant 'driving force' and the second defendant.
