Indictment – Validity. The defendants' convictions on a form of indictment differing from the indictment uploaded electronically by the prosecution onto the Crown Court Digital Case System on which they had been arraigned, by adding one or more counts in respect of which the defendants had not entered a plea, absent an application to amend, were not nullities. The Court of Appeal, Criminal Division, in dismissing their appeals, further held that neither the existence of another indictment or lack of arraignment gave rise to invalidity.
