R v Gohil; R v Preko

Court of Appeal – Jurisdiction. The Court of Appeal, Criminal Division, had jurisdiction to reopen concluded proceedings in cases of nullity, strictly so-called and distinguished from mere irregularities, and where the necessary conditions were satisfied. However, the Court of Appeal, Criminal Division, dismissed the defendants' applications to reopen the final determinations of the full court, dismissing their appeals against convictions, as they satisfied none of the necessary conditions.
