Criminal evidence – Hearsay. The Court of Appeal, Criminal Division, dismissed the defendant's appeal against conviction for one count of possession of a record containing information contrary to s 58(1)(b) of the Terrorism Act 2000. On the facts, there had been no hearsay and no anonymous hearsay issue in circumstances where the recorder had permitted the prosecution to rely upon open source material to establish the intention behind a document which had been the subject of the count, namely, a handwritten list of fitness requirements for a Mujahaddin fighter.
