Town and country planning – Permission for development. The Planning Court allowed the claimant's application for judicial review of the defendant local planning authority's decision to grant planning permission for the erection of a three-storey building next to a school. There had been an error of fact with respect to the availability of sunlight to the school's outdoor area and the assessment which had flowed from it had played a material part in the decision-making process.
